Businessman Leonardo Manzan emphasizes that the evolution of smart grids has been attracting increasing interest in Brazil, as it represents a technological advancement capable of transforming the way electricity is produced, distributed, and consumed. These technologies offer greater efficiency, integration of renewable sources, and active consumer participation, allowing users to play a more dynamic role in the energy chain.

However, despite their advantages, the implementation of smart grids brings legal and regulatory challenges, especially concerning data security, tariff rules, and the protection of consumer rights in a more digitalized and complex environment.

Regulation of Smart Grids in Brazil

According to Leonardo Manzan, smart grids combine advanced metering systems, real-time communication, and intelligent energy flow management. They not only identify failures and reduce distribution losses but also enable consumers to generate their own energy, as in distributed generation, and sell the surplus.

Nonetheless, Brazil’s regulatory framework still needs to evolve to keep up with these innovations. There are gaps regarding the classification of services, the responsibilities of sector agents, and the legal guarantees for consumers and investors, which generates uncertainties and may hinder technological progress in the country.

Main Regulatory Challenges

Leonardo Manzan highlights that one of the most sensitive points is the handling of data collected by smart grids. Smart meters record detailed information about energy consumption habits, peak usage times, and individual user profiles, requiring compliance with the General Data Protection Law (LGPD) to prevent privacy violations.

Furthermore, there is concern about dynamic tariff models. Although these tariffs are technically efficient, they can impose higher costs during peak hours, particularly affecting low-income consumers who have less flexibility to change their consumption patterns.

Opportunities for the Electricity Sector

On the other hand, Leonardo Manzan points out that smart grids offer enormous opportunities to modernize Brazil’s electricity sector. The technology has the potential to reduce operational costs, improve service quality, and allow greater integration of renewable sources into the energy matrix.

In addition, there is strong interest from foreign investors in the development of smart grids in Brazil, but the realization of these investments depends on the creation of clear rules that ensure legal certainty and balance innovation with consumer rights protection.

Best Practices for Companies and Regulators

In this context, Leonardo Manzan suggests that companies wishing to work with smart grids should stay updated on legislative discussions and invest in technological solutions compliant with data protection and cybersecurity requirements. Developing solid technical studies and maintaining constant dialogue with regulatory agencies can facilitate adaptation to the new regulatory scenario.

For regulators, the challenge is to promote innovation while protecting consumers. Creating clear, accessible rules that encourage the use of smart grids is essential to ensure the safe and sustainable development of the electricity sector.

Additionally, Leonardo Manzan notes that in several countries, smart grids are already a reality and play an essential role in modernizing the electrical system. In Brazil, the advancement of this model will depend on the definition of specific regulations that balance the promotion of innovation with the need to ensure transparency, privacy, and fair tariffs for consumers.

Understanding how smart grid regulation will unfold is crucial for companies seeking to invest in the sector and for consumers looking to understand the impacts of this modernization on their lives. According to Leonardo Manzan, the future of the electricity sector depends not only on technology but also on a solid regulatory framework capable of promoting innovation in a balanced and responsible manner.
